Any personal data given to the Consorcio de Compensación de Seguros, with registered address at Paseo de la Castellana nº 32, 28046, Madrid, will be handled for managing and processing the issue and maintenance of the compulsory insurance policy for motor vehicles, contemplated in the Royal Legislative Decree 8/2004, of the 29th of October, by which the consolidated text of the Law on civil liability and insurance for traffic motor vehicles, as well as managing the collection of the premiums, dealing with applications, processing the claims which, if such is the case, could occur and exercising, if relevant, the right of recourse. Likewise, the data will be handled with the aim of preventing fraud in the insurance, as well as for carrying out any possible statistical, actuarial and insurance technique studies.
The Consorcio de Compensación de Seguros will process the personal data for the abovementioned purposes aimed at fulfilling the functions that they have been attributed with by the Legal Statute of the Consorcio de Compensación de Seguros, as well as the remaining applicable legislation. By virtue of this, all the processing of referenced personal data carried out by the Consorcio de Compensación de Seguros is based on the legitimacy of the fulfilment of a legal obligation (art. 6.1 c) RGPD), as well as on the performance of the signed contract (art. 6.1 b) RGPD).
Except when indicated to the contrary, all the data required are necessary to comply with the abovementioned purposes; therefore a refusal to supply them will prevent the continuity of the issue process.
The vehicle¿s data that are included on this contract will be communicated to the Insured Vehicles Information Datasheet, as is established by art. 23 of the Compulsory Civil Liability Insurance for Motor Vehicle Traffic. Additionally, the data may be communicated to banking organisations, for the management of the payments of the insurance contract premium, as well as to other third parties to whom we are legally obliged to provide this data.
In the case of communicating claims, the personal data provided may be accessible by valuation service organisations of personal and/or material damages, accident investigation and reconstruction, as well as by lawyers and Courts, for the correct management of the abovementioned purposes, as well as to fulfil the obligations set forth by the Law.
In the case that you were to provide any data from third parties, you must have the consent of these third parties and undertake to pass on the information contained in this clause to them, as well as informing the Consorcio de Compensación de Seguros of any change or up-date regarding this information. You must guarantee that the affected parties are over the age of 14 years, or to the contrary, that you have the informed consent of their parents or tutors for the communication of the information.
The personal data will be kept throughout the time of the validity of the insurance policy and subsequently, for a period of 10 years from the conclusion of the insurance contract. In the case that on the termination date of the policy validity there were claims still being processed, the personal data will be kept for a period of 10 years from the closure of the claim, recovery or corresponding investigation file; proceeding with the blocking at this moment and only maintaining it at the disposal of the Public Administration, Judges and Courts for the attention of the possible responsibilities arising from the processing and/or any underlying legal relations, during their period of limitation.
You may exercise your rights of access, rectification, opposition, limitation, portability and removal, by a written communication addressed to our Data Protection Delegate through the electronic mailbox dpo@consorseguros.es. Likewise, you are entitled to present an appropriate claim before the Spanish Data Protection Agency (Agencia Española de Protección de Datos) if you consider that the Consorcio de Compensación de Seguros has infringed your rights.
