General information on the FIVA

The "Fichero informativo de vehículos asegurados" (hereinafter, F.I.V.A.) (informative database of insured vehicles), has been functioning since 1996. This database is of a public nature and it is managed by the Consorcio de Compensación de Seguros, to which the legislation attributes the purpose of supplying the necessary information so that people involved in a traffic accident can obtain as soon as possible the circumstances relating to the insurance company that covers the liability of each one of the vehicles involved in the accident and at the same time facilitating the control of the obligation to insure motor liability.

This database contains the data relating to all the vehicles that are normally registered and located in Spain that are insured in respect of compulsory motor insurance liability.

The insurance companies that operate in motor branch are obliged to supply the FIVA updated information on a daily basis through the system known as EDITRAN (database transfer system), sending all the information regarding additions and deletions of insured vehicles, which are identified by their registration number and the manufacturer's model code, supplying, in the case of additions to the database, the date of the beginning and ending of the insurance period, the type of contract and in the case of deletions the date on which the insurance expires.

The information contained in this database is presumed to be accurate for informative purposes, unless proof to the contrary exists.

According to the current legal norms the data contained in the FIVA, until now, was not available to medical centres or emergency medical services, among the people and institutions to which the Consorcio de Compensación de Seguros ceded information and access.

On the occasion of the recent updating of legislation governing civil liability derived from the use and circulation of motor vehicles the Consorcio de Compensación de Seguros has promoted successfully the appropriate legal modification in this subject, in such a way that the law 21/2007, of 11th July, recently approved, has added the following paragraph to section II of article 25 of the collated text of the law governing liability and insurance of motor vehicles:

"Tendrán también acceso a dicha información los centros sanitarios y servicios de emergencias médicas que suscriban convenios con el Consorcio de Compensación de Seguros y las entidades aseguradoras para la asistencia a lesionados de tráfico".
