Consorcio has been entrusted the function of protection of creditors by insurance contract (insured persons, beneficiaries and third parties) in case the regulator orders the liquidation of an insolvent insurance company, or the own company voluntarily asks for its dissolution.

Conforme al artículo 229 del Real Decreto 1060/2015, de 20 de noviembre, de ordenación, supervisión y solvencia de entidades aseguradoras y reaseguradoras, constatada la solvencia de la entidad aseguradora en liquidación, el Consorcio de Compensación de Seguros ha llevado a cabo el proceso de liquidación según lo dispuesto en el capítulo II del Título VII de la Ley 20/2015, de 14 de julio, y sus normas de desarrollo. Así, ha abonado sus créditos con cargo a sus fondos propios a medida que éstos eran líquidos y exigibles, sin necesidad de junta de acreedores. Satisfechos todos los créditos y los derivados de gastos de liquidación, se han consignado en depósito los no reclamados a disposición de sus legítimos dueños durante el plazo de veinte años en el propio Consorcio, transcurrido el cual sin haber sido reclamados se ingresarán en el Tesoro Público.

You should also know that the Consorcio covers up to the legal limit of the Compulsory insurance in force on the date when the claim occurred.
The rest of the amount not covered by the Compulsory Insurance for Motor Vehicles will be the amount that the CCS itself in its liquidating function will take into consideration in the liquidation and therefore it will offer, at the approved percentage, the acquisition of your credit.
